Wayne Woman Accused of Killing Baby Trial Delayed 6 Months

Prosecutors are fighting a decision about evidence inclusion in the case, report says.

The trial of a Wayne woman accused of killing her infant son will be delayed another six months, NorthJersey.com reported. According to the report, the Passaic County Prosecutor’s Office will use the time to fight a judge’s decision that some evidence against township resident Keri Barry could not be used in court.

The prosecution had wanted to use a string of emails and instant messages Barry sent before her son’s death that talked about wanting to end her pregnancy, reports said. Last month, a Superior Court judge ruled that they could be used in court, but not the most inflammatory comments.

Prosecutors say they are seeking to get all of the messages admissible in court, the report said.

Experts say a decision on the appeal could take six months to a year.

According to the report, Barry, now 26, gave birth at home without seeking medical attention in December 2009.

After her family took her to the doctor and allowed for a search of her home, investigators found a male baby’s body wrapped in a garbage bag outside her home, the report said. 

She’s been accused of putting the infant in a plastic bag and causing the asphyxiation that killed him, reports said.
