Top Soil Depot Owner Due Back in Court on Wednesday

Allan Rombough Sr. could have criminal charges brought against him.

The owner of Top Soil Depot is scheduled to appear at a hearing Wednesday after he allegedly visited the business against orders from the state and removed records.

A hearing Friday afternoon was originally supposed to examine the possibility of Allan Rombough Sr. permanently removing hazardous materials and solid waste from the 12-acre site. But the focus of the hearing shifted to examine Rombough visiting the property Thursday and removing records, said State Department of Public Works Spokesman Larry Hajna.

A State Department of Environmental Protection inspector observed Rombough removing the records, Hajna said.

Rombough could have criminal charges brought against him for violating the court order. Rombough needs the state’s permission to visit the property.

The court is scheduled to hear testimony from the DEP and witnesses Wednesday regarding the incident.

The state filed a motion in late April to have Rombough incarcerated until he can show that he complied with the court's order to remove the hazardous materials from the site.

The site is in a floodplain on Pompton Plains Crossroad.

Attorney General Paul Dow won a court order in March compelling the company from collecting solid waste and other material on the site, something Dow said could worsen flooding in the area. The DEP contends that more than 20 companies have delivered more than 22,000 cubic yards of solid waste to the site.
