State Wants 'Top Soil' Owner Jailed

The Record: Illegally dumped material has not been removed from the site.

The state wants the owner of Top Soil Depot to go to jail for his refusal to remove alleged contaminated waste from the 12-acre site in Wayne.

As first reported by The Record, the Department of Environmental Protection (DEP)  filed a motion in state Superior Court to have the owner, Allan Rombough Sr., put in jail until he can show that he complied with the court's order to remove the material.

Attorney General Paul Dow won a court order in March compelling the company from collecting solid waste and other material on the site, something Dow said could worsen flooding in the area.

That court order is one of many that has been levied against the company.

The DEP contends that more than 20 companies have delivered more than 22,000 cubic yards of solid waste to the site.
