Wayne Hills Students Banned From Football As Team Heads To State Championships
Board of Education outlines a multi-point plan to prevent any further incidents.
Nine Wayne Hills High School football players charged with aggravated assault are barred from participating in extracurricular activities, a week before the team heads to the state sectional championships, according to a decision by the Wayne Board of Education Friday.
The school board voted unanimously after an emergency hearing to uphold a previous ruling by Interim Superintendent Michael Roth to suspend the players, who were charged in an Oct. 29 incident with attacking two Wayne Valley High School teenagers after a party on Urban Club Road.
Board members Robyn Kingston and Jane Hutchinson listened to the hearing via speakerphone and cast their vote with the remaining board members.
"The events that allegedly occurred at a private party on Oct. 29 which involved several students has left a black mark on our community," Board of Education Trustee Robert Ceberio said during a 1 p.m. press conference following a three-hour hearing, most of which was closed to the public.
"This is not characteristic of the majority of our 8,700 students who truly reflect the good of our district and community. The Wayne Board of Education believes that violence is unacceptable related to our school, connected to extracurricular activities or in our community," Ceberio said, reading from a written statement. He said the day to day operations of the district had been impacted by the incident.
More than three dozen people, including lawyers for some of the charged football players, waited outside the Board of Education offices — which were locked by school officials — during the 10 a.m. meeting. The football players were not in attendance. Among the other issues discussed, the board outlined a plan, which included a new universal code of conduct, to prevent similar situations from occurring in the future, Ceberio said.
The special meeting was announced Wednesday after the Passaic County prosecutor warned the board that holding a planned hearing that would introduce new evidence in the case could jeopardize an ongoing aggravated assault investigation.
Responding to criticism of the board’s decision to announce the ruling on the day after Thanksgiving, when schools are closed, Roth said the meeting was held Friday because the prosecutor’s concerns effectively canceled the hearing scheduled for Nov. 29.
"The concern was that the criminal investigation would be hampered and compromised," Ceberio added.
The Nov. 29 hearing was to include testimony from attorneys representing several Wayne Hills players.
Attorney Darren Del Sardo, a former board trustee who is representing one of the nine Hills players, has said that his client was not present at the alleged altercation.
"They have a duty to protect the innocent and they failed miserably," Del Sardo said.
In a statement issued Friday in response to the board's decision, Del Sardo and George Abdy, an attorney for another boy charged in the incident, accused the board of "caving to a mob mentality that has been spread across the internet."
"The mischaracterization of the incident is driving the actions of the school board which has failed to consider the facts of the case and instead is reacting to anonymous internet posts," the attorneys said.
Ceberio acknowledged during the hearing that police, because of the ongoing investigation, could not divulge any information to the school district, making the board's decision even more difficult.
“We were not provided with police reports, and to this day, do not know on what basis the charges were made,” Ceberio said.
Announcing a plan to be implemented in coming weeks, the board outlined several steps it will take as a result of the incident.
- A unified student athlete code of conduct will be introduced. Currently, each school has its own, and they each differ from school to school.
- Programs dealing with conflict resolution, non-violent communication skills, anger management, and bystander responsibility will be developed.
- Officials are examining creating the position of school disciplinarians at both high schools.
- The board will ask the new superintendent, Ray Gonzalez, to assemble a task force to look at this matter and report back to the board with “recommendations to improve process, procedure, and policy.”
- The board will also ask state Attorney General Paula Dowd to monitor this case as it proceeds through the judicial process and to review the incident under the state’s Harassment, Intimidation, and Bullying statute.
Friday's ruling came after district officials seemed to waffle several times over whether to allow the players to take the field.
On Nov. 11, Roth allowed the players to participate in the team’s first-round state playoff game against Vernon after citing case law that stated players charged with a crime could not be banned from sports before charges are resolved. Wayne Hills won 48-0.
Less than a week later, on Nov. 16, Roth announced the players would be banned from participating in extracurricular activities.
But the board put Roth's ban on hold on Nov. 17, after hundreds crowded into the municipal building to support the beleaguered football players, and allowed them to play in the game against Paramus.
Eight of the nine players are juveniles. The ninth is 18-year-old team captain and star wide receiver Andrew Monaghan. Monaghan and teammate Joe Lane, 18, were also disciplined last week for their alleged involvement in an incident at a pep rally at Hills before the Paramus game.
Audio transcriptions of the Nov. 17 closed-door hearing with district officials, the board, players, and their lawyers, will be forwarded to the prosecutor’s office and the Wayne Police Department’s Criminal Investigation Unit.
Trustees will review district policies to “address the conflict of interest concerns when administrators, and/or supervisors act as a coach or assistant coach."
Hills varsity head football coach Christian Olsen is also the school’s athletic director.
Olsen and Roth could not immediately be reached for comment.
The team wil face off against Old Tappan at MetLife Stadium in the Meadowlands Dec. 3. Wayne Hills has won seven state championships since 2002.

This all could have been avoided if Olsen had sat the nine players out at the Vernon game. Hills could of won that game with the remaining players available. Instead he blamed the superintendent. As head coach he can play or not play any eligible dressed player for that particular game without question,message would have been received the mass majority would of been happy,Olsen could of come out looking like a respectable person and coach but instead he went in the opposite direction pitted neighbor against neighbor and caused irreparable damage to the people of Wayne. The leaders of the BOE are culpable in all of this also the let the biggest bully in Wayne get his way. It took a threatening letter from the Passaic County Prosecutor to wake up the BOE and their poor choice for legal council.

I agree with John when he states Olsen should have sat the 9 players out from the beginning. But that would have never happened as seen by the following actions of his defense of his players and show at the last BOE meeting.
This all could have really been avoided if the BOE had done what they were elected to do: see that Policy is followed. What confuses me is the statement that the BOE has come up with a "Universal Code of Conduct" which will avoid future situations of this kind. The fact is there is a Code of Conduct already in place at the high schools. The fact is there are Policies & Proceedures already in place on discipline in the District. All the BOE Trustees needed to do was FOLLOW IT! Not overturn it with a 9 vote decision which in effect created a change in policy. Instead they found themselves being Judge & Jury. It's a pity it took a letter from the County Prosecutor to make them back down. They should have know better. They should have had better legal advise. They should have done what elected to do: FOLLOW POLICY!
The Policy is there to avoid the caving to public pressure...the kind which was displayed at the last BOE meeting. It's a real pity it has all come to this. It's a pity that the BOE thinks it's the actions of the assault that has left a black mark on the district; when it is their own irresponsible actions that has left the black mark.
Time for all to heal now.....time to get back to the business of educating kids.

I agree wholeheartedly. I think he should be let go. What kind of an example is he setting for our children. He is an embarrassment to the Town of Wayne and we need to disassociate with someone like that. I believe the Board should call for immediate resignation for Coach Olsen. Maybe they can get a real man with real morals to take his position. They may not be able to beat a team 48-0 if they take on a new coach, but at least we will be able to told our heads high again as a town, and know that once their four-year stint as football players in high school is over, we are raising kids who know right from wrong and who are accountable for their actions. After all, there IS life after high school football. I still say shame, shame, shame on the parents for listeing to this oversized Bully to begin with. Shame on the Board for backing down just because there was a ridiculous showing of the suited up Hills boys consuming the first 2 rows, donning their new black uniforms - having Coach Olsen stare into the face of every board member in a bullying manner. I do think we should also try to get rid of the rivalry between Valley and Hills and separate the two teams so they don't play one another.

Whether one agrees that the kids should play or not play - our Board of Education looks incredibly indecisive. This BOE should all be recalled. They've consistently made an absolute mess over the superintendent position and have now created a debacle with their waffling over this current matter. The BOE believes these players give Wayne a black mark - they're not doing too well themselves. If they had integrity, they'd all resign so we could start from scratch (but I fear they'd change their minds the next day). Hence, recall them all.

The BOE handled this whole situation poorly. Now they made an even worse decision with the hopes of getting reelected. It's not about kids playing or not playing. As I said before just having the meeting potentially puts the criminal case at jeopardy. If the kids play they still face the consequences of the criminal case. Their has been case law that states " no private or public authority should make any decisions that could effect the outcome of a legal trial before the trial takes place." What the BOE did COULD be the deciding factor in the legal case. Which could open the whole town up to a law suite from either side of the courts decision. All because people are. Screaming for blood regardless of any innocent people that get hurt in the process. Just because the board couldn't take the heat. Sometimes doing the "right thing" isn't a matter of making a decision but waiting until all the information is available. Can't wait to see how much money this is gonna cost the town in the long run.

Couldn't have said it better. The BOE put itself in a part of the "Due Process" that it shouldn't have. They weren't sucked in, they did so only because of the "elected" power they have instilled with-in themselves. Forget the team, the township cannot come out of this without a black-eye. They Bullied themselves right into a corner and have "no-one" to accuse but themselves. Only Mr. Superintendent Roth ( our $3500. a day man ) get's to walk away twirling his cane and tipping his top-hat, as the rest of us stand around with our hands in our pockets, looking away, and whistling "Mack the Knife".

i couldn't disagree more. i have read very few posts where people are "screaming for blood" as you put it. it isn't so much the actions of the boys as it is how the adults in charge (olsen, BOE the parents) handled the whole thing. that is what people are responding to. you have consistently seemed either confused or just stubborn in your posts. either way, like olsen, you just don't get it.

Our BOE has showed us how incredibly INDECISIVE they are. They have flip flopped to the point of embarrasment. Pavlak should step down as President as he shows no leadership at all. The Board attorney should be fired, although that would piss Rumana off and God forbid, the Board could not do that. They're all beholden to him. Personally, I'm happy these kids are banned from playing. They should have been banned from the getgo, in my opinion. This whole matter has been a huge embarrasment to Wayne and poorly handled from the outset. It's downright embarrasing. These BOE trustees need to go!

I hope you cry babies are happy now. So much for the great USA and innocent until proven guilty. Let’s not let the facts get in the way. There is a lot more to this story than has been told. These “victims” were not left unconscious in the streets. They were conscious and actually walked to the Police car and were sitting there waiting for the ambulance.
Listening to the media you would think they were left in the streets to die.These “victims” were actually the aggressors earlier in the evening at a previous fight . I am not condoning violence; however, no action should have been taken until the Passaic County Prosecutor has completed the investigation. THEN……… if they are guilty, let them have the proper consequences.
If they were not on the football team, this would not be the big deal that it is. This was a fight between high school kids. High School fights have always happened and always will.

Jerdeyguy ... Interesting that you are confrontational and we need to be called "crybabies". It seems that some can't distinguish between what is simply acceptable conduct for students with the PRIVILEGE and RESPONSIBILITIES of being on the football and legal procedure. ALL involved in such behavior should be suspended from extracurricular activities and privileges. Letting the legal system assess guilt or innocence by due process is a separate matter. BTW ... the condition of the person who was subjected to the most brutal attack in the brawl (as evidenced by the need to wait for an ambulance) is not the criteria by which to judge the gravity of the incident or its consequences. But may I ask the rhetorical question: "Who appears to be the victim? ... the one waiting for an ambulance ... or the ones who made the wait necessary?" Also, it would be a shame if the taxpayers needed to foot the bill for a defense if parents of the antagonists decided to vent their frustration on the BOE and Wayne Township and NOT toward the antogonists ... THEIR CHILDREN.

The entire board, new and old obviously all agreed with a 9-0 vote to let them play. Shame on anyone who did not vote with their own intention. I am fond of the whole board, they are all good people, I just know they really dropped the ball on this one and made a hugh mistake. Sometimes good people make mistakes....it doen't have to be a cause for personal attacks. As for their ability to serve..well that's for the voters to decide. That's when their record will speak for them.

That case was decided BEFORE the NJ HIB (Harassment, Intimidation, Bullying) law went into effect as of the beginning of this school year. The new HIB law actually requires schools to be responsible for students' actions outside of school at non school related events.

As to a few of the recommendations of this inept BOE: 1) There is a Code of Conduct; 2) Consider creating a position of school disciplinarian?... Wouldn't that be the principal?3) Ask the State Attorney General to monitor the case as to the bullying statute: this case is so muddied already thanks to the BOE, they should just stay out of it. Whether one agrees or disagrees with the decision (the most recent one as of 11/25 - it may change again), please remember how poorly this entire board handled this situation when school board elections come up in the spring.

Good Decision.
This controversy is defiitely causing a disruption to both schools. At least there is a plan for the BOE to offer some programs moving forward to hopefully not be at this place again.
News Channel 12 said some/all of the players will appeal this decision to the courts.
This ain't over yet.

Yeah..... News 12 once again said they were left "unconscious laying in the street". This is not true. These "victims" walked to the Police car and were sitting very much conscious in the back seat of the Police car. The BOE said in a statement that they did not have all the facts because the Prosecutor said it would hinder the criminal investigation. THAT BEING THE CASE..... they should not have ruled until the facts were known...... MARK MY WORDS this will be overturned next week by the NJ State Courts.

9 WHHS Football players get into a fight and are charged with Ag Assault during football season. Suspended from playing Championship game. Got it.
4 WVHS students get arrested at WV/WH Football game for CDS.
Suspended from school for at least 2 weeks, with taxpayer tutor.
Still allowed to participate in their up coming respective sports. Got it.
Will let my child know not to make mistakes in season.

Aggravated assault vs. CDS? That's comparing "apples to oranges." As a parent of former WV students, high school was a real "eye-opener" to the amount of PARENTS who condone (and participate in) the use of CDS! It appears that WV followed policy, as long as the students did not participate during their suspension. I am not familiar with the new HIB policy...

CDS does not fall under the HIB laws, for the record.
The discipline code of the high school should spell out how an incident involving CDS is handled, along with the Police being called in as well.

Lets be clear people, the Ramapo / Indian Hills case was related to alcohol, not assault, and the judge ruled the school board was enforcing a policy not in line with the state statutes at the time relating to off campus activities. Wayne's decision relates to actual arrests for aggravated assault and the BOE can clearly relate those activities to the recently enacted H I B laws in the code which may in fact relate to actions off campus. Not a clear parallel by any means.

30 years ago 8 student athletes and I committed a crime in Wayne. There are many similarities to the current situation that is being questioned today. Howerever, we (the guilty students) acted differently. We were going to have privledges taken away from our entire class if we didn't turn ourselves in. the next day, we all went down to the police station and turned ourselves in. We knew that there was going to be consequences but we did it anyway because we knew it was the right thing. We appologies to everyone for what we had done and we took care of our crime. Without being asked, we did 2 weeks of community service. When it was time to face the judge in court we had everyone in the town supporting us, parents, teachers, students. The judge was very proud of us and our actions that we personally shook all of our hands and thanked us for being such great roll models. Today, most of us have moved away and we have all turned out to be great leaders in our communities. We are all great fathers and loving husbands none of us have been divorced.
Maybe, what this town needed was a true leader in one or more of these boys to stand up and admit to what they have done like we did 30 years ago and this issue will go away and a leader will emerge.

The code of conduct varies from school to shool in Wayne. The BOE wants to set a "unified law" in place. At the time of the incident ( Oct.29th ) the code of conduct did not include a students actions off of school grounds. Maybe it did in Wayne Valley, but not in Wayne Hills. The ruling today is illegal, the Superior Court will have to over-turn the decision unless the BOE can prove other-wise.
Residents don't seem to understand that the rules for the 2 high-schools are different, and although they are going to be the same, right now they are not.
Don't blame coach Olsen for following the rules. He's following the rules that are with-in his guidlines.
"You can't make this stuff up" !!! The BOE should all be fired.

as you read, there are plenty of those posted, that had fights in h.s. with different outcomes than mentioned in this case. i am one of them. i lost a fight that was me on 4. i had the whole bloody nose, lip, stitches thing but no cops. i eventually evened the score, and moved on. remember, in the 70's we didn't cell phones, txt , or parents with attorney's on retainer. you beat up a classmate, his older brother pounded you in some hallway, and you moved on. we had great times fighting guys from pompton lakes, oakland, paterson and who knows where else. we didn't win them all, but we didn't lose any for long. and "yeah" i feel good about it. it was a part of growing up. turf mattered. the town's name meant something...like it belonged to us. we called WHM and T-Bowl home, and defended what little we had.
there weren't any handbooks in those days. if there was, i never got one.

...and no ira, i don't have a student in either wayne high-school. let's say such a law exists. what stops an opposing school from starting a fight, calling the police to break it up, and signing complaints against the opposing participants ? Such a law would be absurd. such a law would promote a rivalry of revenge. such a law would be against the law unless specific boundries ( property lines ) were included.
freedom of speech doesn't entitle a person a freedom of access to make a speech. going in same direction, the board of education cannot make a law eiliminating fighting, drinking, dugs, or sex outside the school zones. they can make it a law that a student can't participate in school, or in projects after-school, but that would all have to be established...and it's not.
I did have a student that competed in sports in wh ( not long ago ) and read/ signed all the paperwork. nothing in the paperwork or manual states that if a student is arrested and is still allowed to attend school, they are banned from participating in after-school programs/sports. I have several booklets here, and none of them have it. maybe wayne valley does, wayne hills does not. the reference you gave for student responsibilities is worthless.
you need to find a rule that states while a student has been arrested, but not suspended, the student cannot participate in after-school sports or programs until after the matter has been resolved. then you have a case.

I think it's safe to say that no matter what people are going to bitch about this.
Look, even if these WV kids provoked the fight or started it or whatever, they were the ones kicked and beaten. Not the WH kids. I tell my own students all the time to make the right decision when being provoked by another student, and that is to be the bigger person and walk away. Because if they take action themselves and decide to throw a punch, they will ultimately be the ones getting in trouble for the bigger offense. The WH kids didn't walk away and committed the bigger offense. For all we know the WV boys started it. But we will never truly know. What we do know is that they were beat up, and I hope they're doing okay. And there needed to be some consequences. If the WH players had just been sat out in the first place this could've been avoided. I am personally disappointed that we don't have a town wide student athlete code of conduct and I think its sad that it takes an incident like this to create one. And even if both schools have their own, there shouldn't be a HUGE difference between them. If there is, well, that's a problem. I just hope we can all move past this. How about taking the steps to make Wayne a respected town once again. Don't keep fueling the fire between schools. Set an example for the kids and encourage them to come back together as WAYNE, not WV and WH.

But it would be an issue if the student athlet has a pending criminal charge they should not be in extra curricular sports. That's what the policy should be. Once the school is notified that there is a charge pending the Principal should pull the student and explain no extras till the charges are dropped or settled.
Bad behavior should not be rewarded by no consequence.
Thar already happened and look at the result..empowerment. Let's ask the teacher whose eye was injured at that pep rally if the BOE was any help in validating authority? Kids usually think themselves untouchable as it is....much worse when u have a board that agrees!!!

I cannot understand why 2 schools in the same town have different Codes of Conduct for athletes. It seems like Common Sense that both schools that are supported by the taxpayers of this town would be unified in their expectations of students' behavior. Makes me wonder who decided that the individual school's should create their own Code of Conduct and WHO creates that code?? the Athletic Directors maybe?? I can only hope that the new superintendent will bring stability to the Wayne school district and unify the standards. It's a big job and I hope Mr. Gonzalez is up for it.

30 years ago, when my friends andI did our crime in Wayne we turned ourselves in for the good of the school. We emerged as heros and today we are all very sucessful.
The alleged students need to admit their fault immediately and all will be saved. I know from experience. The leaders of the accused (parents,clergy,coach, etc) need to step in and get the kids to do the right thing or the team and the town will suffer.

Life lessons need to be taught and obviously the parents of the accused / "charged" players are at the heart of this issue. They have failed miserably as parents! So in an effort to take the spotlight off of their inexcusable lack of basic parenting skills, a twisted group of parents now look to high priced attorneys to defend a child's "right's" to PLAY HS FOOTBALL on the backs of the taxpayers. Remember all school sanctioned extra-curricular activities are PRIVILEGES earned by students and can be taken away at any time period!
If I still lived in Wayne I would start a petition to unify the township and create ONE WAYNE High School sports program. It would save the township millions of dollars long term by eliminating the need for duplicity of resources. This unified "Hills/Valley" system would enable the township to capitalize on its size and pool of student athletes. Just imagine for a moment the town unity and comradery this would create! Wayne citizens cheering for Wayne student athletes what a concept! Wayne, now more than ever, needs leadership and innovative thinking. I sure hope that someone can step up and provide that... sooner rather then later.

Listen WWWD (ignoramus) ... it would not matter what extracurricular activities the students were involved in... from the debate team to student government, chorus to the math club the end result for their "actions" would be the same. No such luck with Donna Reed...by the way my parents were Italian immigrants who came to this country in the search for a better life. They worked their tails off and sent me to a Catholic grammar school and high school where corporal punishment was the rule of thumb. I, like most kids, did stupid things but I suffered consequences for them unlike the "spoon fed" kids in question here. It's really sad for me because I coached a few of the boys on both high school football teams travel soccer when they were younger and I hope and pray none were involved in this incident.
I have two children by the way who "knock on wood" know the basic difference between right and wrong. Have I always made the right decisions as a "parent" probably not but in the big picture they are turning out to be model students and citizens.

I just hope no one lets the Board hoodwink them with this "new plan they will be taking as a result of this incident" when the truth is they had everything they needed already. Roth already banned the 9 from the games. The Board allowed themselves to be bullied by Olsen. Horrible leadership. Not one of them could muster up the courage or sense to say "I'm sorry coach, folks, the decision has been made.These kids acted badly and we need to send a message to our community and children and follow the code of conduct." NOT ONE.
Now they are back-pedaling and hiding behind this shroud of "Oh gee, the rules were all clouded and we were confused so we will work hard to come up with a new plan." What complete BS. There isn't even an explanation in the article for WHY they waffled and overturned Roth's decision. Other than the implication of feeling pressured by the scores of angry parents and Hills players that showed up to the meeting with Olsen at the helm. If you can't handle angry people disagreeing with a decision then why are you in a position of leadership?
It is good that they finally banned the 9 from games. But obviously it was a political move; they had no other choice really, after the mess they created. These Board members are spineless. We need real leadership. Wayne deserves better. Remeber this at election time!

Fact#3- A week or so later enough evidence was presented to bring charges of aggravated assault to nine football players which could result in up to 5-years in prison for the 18 year old named student.

Fact#5- Mr. Olsen continues to allow the students to play and rewards #1 with leading the team onto the field in the very next game. Again ZERO consequence for their alleged participation in the attack.

Last time I checked Olsen isn't being investigated for anything. Please explain to me what he's guilty of? something other then. Making one of the most successful football programs in the country? Nope, only your ignorance. I coached at that point an innocent group of young boys under 10 years of age. Ultra competitive parents was always my greatest hurdle... you can't blame the kids! They have become a product of their environment.
As for my championship...let's see it is not a silly game! It's having two kids (20 and 16) who are growing up to be valued citizens in the community, not some thugs on a street corner dealing drugs or robing houses or disrespecting authority.

Let me start off by saying that as a Wayne resident that I'm appailed with the behavior of adults. I can not believe that anyone would blame the Coach for an insident that happened at a private party at a private home during off hours. Boys will fight and this is nothing new in any town in America. But all you people have got to stop holding a coach responsible for the actions of boys on both sides of this issue. This man is like a father to all players who have played and are playing for him, whether it is football, baseball or any other sport that he has coahed and taken time out of his day over there years. He goes out of his way to make sure that all these boys do the right thing by themselves and others. Maybe you all should find out all the facts of the case before jumping to judgement about one person and the program that he has nurtured over many years to make it the program it has become. Non of the haters of this man seem to care about the facts but only want the head of a man who has given of himself to a town that should appreciate what he has done and hopefuly will do in the future. I hope that maybe instead of speading hate and dividing this town, we should find out more about what actually happened that night and let the due process happen. All you arm chair coaches, lawyers and detectives should stop and let the people who are trained to this do there jobs before you think you can do it better

A real father, coach and man, mentor's his offspring / pupils and instills honor and integrity as a basis for living life. Rewarding the 18 year old with the coin toss and carrying the flag in that game was his twisted way of sticking his middle finger up in the air at everyone saying "you see I run the show and make the rules" and F all of you. #1 really learned a lesson that day... so much so that he thought it would be ok to disobey a teacher a week later during school spirit week pep rally resulting in an eye injury. And he still played in the game that evening.... WOW

George, when these kid are small we teach them how to play the game and good sportmanship. As they get older the focus goes from not only learning any game but the ability to when the game. We can debate this all day but at your job is it about giving up if the job becomes more difficult or is about doing what it takes to get the job done to the best of your ability. The BOE's actions are basically against all rules and regulations set out by the State of New Jersey. They are not a totalitarian government, and should leave all decisions and punishments up to the court systems. Schools have no right to punish students for actions that occur off campus, especially when it is being handled by the judicial system, without a written contract or some form of consent between the student and the school. Since the BOE has not recieved the police reports, they are convicting these students based on heresay and interfering with the outcome of the court case. Another problematic issue is that the BOE is having PRIVATE hearings about these PUBLIC school students. These students weren't even allowed to have legal representation while their fate was decided by distant parties that recieved the case information by word of mouth and newspaper clippings.

still in town 78 - A minor can enter into any contract that an adult can, but the minor can disaffirm the contract to express his or her intent not to be bound by said contract. What I was referring to above is a participation request form, where the participant and the legal guardian sign a contract that says they will abide by certain rules set out in the contract - for example, the contract may state that an athlete shall not drink alcohol while participating in a school sport. These contracts will often state that if the student gets in trouble with the law, the school has the right to reprimand them. If the school does not require their athletes to sign a consent form containing the written rules that the student must follow to play a sport, then the school does not have the right to punish them for their actions outside of school grounds.

There are many things the BOE can do that does not apply to the "regular" legal system. I do not know how that works but it does. This comes down the the solicitors for the BOE. It appears that they have changed their minds several times here. Do they know what they are doing or are the laws so vague they can not figure them out. I can not imagine that this has not happened before in our state. If they did get it wrong then shame on them. If there is no school board policy on this then shame on the BOE and the solicitor. We are all guessing here as to the law and how it applies to this situation. A lot of mistakes were made by all the powers to be. From the coach, principal the board and parents of the kids involved. The bottom line the actions or inactions taken taught the kids nothing and 2 kids who got beat up are no longer in the scope of this conversation. Remember them?

Too many young men have had their health and lives ruined by injuries (including many mental, social, and psychological injuries) suffered whilst playing this silly game.
All of the lifelong lessons that proponents of football claim can be better leant through participation in a whole slew of other activities, including nearly any other sport!

In today's Sunday Bergen Record, Coach Olsen shows his arrogance and lack of professionalism. It states " Olsen has said he doesn't need the accused players to win". Isn't that an insult to the opposing team? Insn't that somewhat demeaning to the 9 who have played their hearts out during this entire season? Would Coach Olsen say to his son Kevin, I don't need you to win. Isn't this an insult to highschool football? He then tells the Board on Nov 17th, he doesn't need to win any more football games! Is this arrogance or what?. It is conduct unbecoming of a head coach and an AD. This guy not only represents our school, but our town. In my opinion, he should be removed as head coach and AD.

If the minors involved in this incident are not supposed to be identified, won't the world figure out who they are when they see who is missing?
If this happened in October why didn't it come out until after the election? Ceberio was running for Freeholder and Pavlak is a cop who runs the records room at the Wayne PD, he is also the son of former Chief Pavlak.
It doesn't seem the extra time was used to do a complete investigation, seems at least one of the nine was in Pennsylvania when the incident occurred. Politics over police work? What is their excuse for burying this story until after the election? Does anyone buy iy?

If even 1 of the 8 minors was actually in Pennsylvania when this incident occurred then we as a community have unfairly punished an innocent youth. What message is that sending? Well, I will say I am pleased that the majority of the posters here know right from wrong, The others, unfortunately, are just apologists and enablers, who may be students masquerading as adults, or adults who are essentially absentee parents in their own home, who don't lay down the law in their own homes, and certainly don't want the school to do it. Although the Coach does bear some responsibility, he could certainly have benched them, THE PARENTS are the real culprits. You can see by their posts. As a Wayne resident and father of High School students, I have seen these absentee parents in action and have been fighting an up hill battle trying to keep mine in line for over ten years. Parenting has been a chore for them. That's why their kids can drink at parties, get on party buses for formals, and a host of other illegal activity. and there are no repercussions. I moved here because I thought this was an upscale area with people who held conservative values. I see however that most of that was Bu** S**t.

The "rules of conduct" provided to the students is like the Bible, it is written in a language that needs additional supervision and interpretation. In some cases such as cutting class, or skipping school the language is clear, in cases such as this one, the code of conduct is being used as an " Aesthetic interpretation" by applying an explanation the same way a person would explain art work.
The attorney's on the other-hand, have appealed the aesthetic explanation, demanding a "Judicial interpretation" or an interpretation of the conduct code by a judiciary be assembled to define the language.
The BOE, seeking their own explanation of the conduct code, are requesting Paula Dow, to also give an interpretation of the same code. In this case, they are requesting a "Statutory interpretation" of the same code or "rules".
Like the Bible, there are several interpretations to each meaning or passage. They are all "Authentic interpretations" depending on who you talk to. All of which are only a "Literary theory", or a wide variety of methods used to interpret the conduct code.
Until this incident, the BOE used "Allegorical interpretation" approach that assumes a text should be automatically interpreted literally.
The code of conduct (bible) has never been challenged.

I'm thankful that the boe came to this decision. It's a shame that the policy was unclear - my feeling is that you may be creating an unsafe environment for all the other kids by letting those charged with assault attend school. I feel the police didn't charge with aggravated assault for no reason and the prosecutor hadn't yet dropped the charges. All kids, regardless of their background, should be expelled from school and tutored at home at taxpayer expense (they do have a right to an education) until a legal decision is made. This had nothing to do with a football game, a bad coach, or an inept boe. This has to do with people that need to rely on policies because there is a great lack of common sense. If accused felons had been allowed to play sports in the past, that would also be wrong. I am glad this is now being reviewed. April is the month that you can vote for a new boe - it will take 3 years to get this board out.

If you're charged by the police, you're out. Done. Let the legal system do its job. No tolerance. If the 2 valley kids were charged with assault, yes, they should also be banned from school. I know these posts have been about the 9 playing football, but if you're banned from school, you should also be banned from any privileges (including sports, debate club, band, basket weaving).

This incident shouldn't have a bearing on raising the bar for public education in Wayne. What is needed more than a "positive role model " is a positive role" model of of education". Not one person, "all people". Many other "education systems" in our surrounding towns have taken the necessary steps already. They raised the GPA minimum average for students wanting to pursue "extra-curricular activities", they did away with report cards and replaced them with "portals" that allow parents to go on line ( any-time ) to view their students grades, homework assignments, and attendence. They eliminated daily Gym class for athletes, and supplied student tutor's during school hours, so those that need extra help-can get it. They don't use honor students as " show cases ". They interest them in voluntary tutor programs by providing certificates that become part of their college applications. This helps them log "community service hours".
Schools have also eliminated such things as independant sports dinners, by having sports award dinners as a group ( fall sports, winter, and spring ). They challenge students to achieve higher goals and standards "daily" by increasing the tools needed to achieve those goals. Some of the "tools" are positive communication, positive reinforcement, student of the day programs, etc.
Wayne offers very little when you look outside our twnship. We offer the basic's, then Pat ourselves on the backs for how well we're doing!

Did I type something false or defamatory? Why was it deleted? I stated that Ceberio was running for Freeholder, I said that Pavlak is a Wayne cop who runs the records room for the Wayne PD and I asked why the whole incident was kept quiet until after the election. Those facts and that question are important. Had this not been keep hidden for so long perhaps the facts re: the incident would have come to light by now and we would be better able to decide what the right path is. Instead Boss Rumana's boys played political football with the Wayne police department in order to avoid pre-election controversy and a controversy it is!

I know all the names and #'s were mentioned on Max Preps, facebook and a few others.
I read the the nite it happened. I know most of the students at both high-schools know who, why, and where. I also know it's not a big issue any-more. Those that are close ( but not involved ) seemed to have the same story : It wasn't 9 on 2, 2 started with 3. Now, as adults- we know it's a political issue and the students are being used as weapons. We also know Pav's a cigar smokin buddy bud with those directing him over the hurdles. We know there is an underlining agenda that squashed the event between 10/29 and election day. It's also obvious that he knew he couldn't win when the attorney's met in the closed session, that's why the players ban was lifted. He left that evening knowing he would reverse the decision when he was surrounded by his "own" people- not professionals citing case law. He also knew that he didn't have a need to run for cover, all he had to say was " the police made the arrests not the BOE. The meeting was only to find out tidbits of information that filled in the blanks, making his "day job" easier. What a package deal.

Shame on these parents, the coach and the BOE. The victims are the WH and WV boys involved, my kids, your kids and all others. They look to us to set the example, determine right from wrong, and face consequences based on actions.
Lastly, what kind of parents let their children (18, 17, or 2) out in an automobile during such a wicked and dangerous snowstorm. I have three teens and they were all home safe in their homes where they belonged. Maybe if these boys were home, they would still be playing in the State Championship and the community would not be suffering from all this???? I wonder if this thought has crossed their parents' minds?

The fact that you ask that question, indicates the level of how out of touch you are with both reality and what is appropriate conduct for minors. Do you have Teenagers in the Wayne school system? Do you approve of the drinking and other activity that goes on? It has everything to do with what happened that night. Do you think there was no liquor at the party?

If you read the entire LEGAL document you will see that the NJSIAA Board of Directors conducted a thorough investigation and is not solely based on one persons account. I am being more than fair here. It's a public document that details a "history" of "run-ins" with the NJSIAA.

Um, wow. I really don't see why everyone is blowing this up so much bigger than it needs to be. It comes down to there being consequences for doing something wrong. They got in a fight. The two WV kids were the ones found beat up. So the WH kids got charged. So they lose a privilage. The end. I don't even think this should've made it to the BOE. It should've been as simple as the parents punishing their own children, or Olsen sitting them out for a game or two for not representing the team well. And then this whole thing could be handled quietly amongst the lawyers and whoever and the rest of the Hills season could continue. That's obviously not what happened, but whatever. Shit happens. You deal with it. You do something wrong, there are consequences. Whatever happened to MORALS. It's like everyone's trying to find a loophole in the law to put the idea of morals aside!

@ dory I agree with you mostly and the coach could have probably sat them for a game or 2 for breaking a team rule. Back then coaches had a little more leeway with disciplining players. But at the time you don't know if Olsen was told by someone ( lawyers, the BOE, the Wayne police, or the Wayne hills administration.) To not do anything to not hinder the investigation. Some times the good old days were better that way.

I believe myself to be sane and I can agree with his point of view. In America, we have the value of Innocent Until Proven Guilty. Seeing as how the incident took place off of school grounds, the school district has no right to take any disciplinary actions until the legal system sees fit to. Coach Olsen is a loving father of 3 children, one of them a professional football player. He treats his players in the same way he would stick up for his son if he were ever tied in to this problem. I have been haunted by the IRS for the past 3 years, and after calling Patrick Cox personally from TaxMasters, I have now settled my debts and can focus on important things such as high-school football as opposed to establishing myself on the professional level. This makes me an expert on the topic, and therefore correct.

why are you wasting your time on 78? he feels strongly about his opinon and is entitled to one like everyone else. but he clearly doesn't really get that he is talking apples (due process, the coach is great, the kids are innocent, blah blah) and we are talking oranges (the adults handled this badly, they sent the wrong message to our children and the community, the BOE showed a serious lack of leadership, etc). you aren't even arguing the same points! as for who he really is i can offer a brief forensic psychological profile based on the limited info here: I would say someone with a low sense of esteem and importance, resentful of his underacheivements, living in other's shadows, slightly grandiose but blames his lack of success on some sort of victimization preventing him from reaching higher goals, and obsessed with this topic as evidenced by his apparent need to appoint himself the important role of defending the kids in a way that suggests he thinks only he can do, and perhaps Coach Olsen who he may be looking for approval from. It's not my job or my intention to convict the kids. All the kids that night made "bad" choices. In life there are consequences for your actions and inactions... Ask Joe Paterno and his "PROGRAM". This larger than life "program" that you are so proud of I'm sure is right up there with the American Red Cross.

I am really surprised that there is this much out cry from a suspension from a football game. Is it really that big of a deal? To have lawyers fighting to let them play? Really? I 100% agree the boys should be suspended since they are charged with a felony.I 100% agree that Olsen may have used poor judgement by allowing the charged to play up until now. However I agree with Rocket, as a Wayne resident, I will be rooting for Wayne Hills in the Championship game. The rest of the players on the team deserve the support from the town. They did nothing wrong. They have worked hard all year and deserve the support of our community. Becasue you disagree with Coach Olsen or do not like him, you should not take it out on the players of the team. And hopefully with these 9 out, someone else gets a chance to shine on the team and step up to be a hero in a win.

This is what would define a TRUE CHAMPION.
The entire team lead by the head coach issues a statement and it reads something along these lines: "Given the grim headlines at Penn State and Syracuse life doesn't begin and end on the field of play. We respectfully withdraw our eligibility and forfeit our participation in this weeks State Championship game. Never shall a game or a win come before what is wrong and right. Hey, mistakes happen... our friends, team mates, coach, and administrators used poor judgement but it doesn't define who we are as people. It's how we learn and recover from those mistakes that prepare us for the challenges that lay ahead as fathers and future leaders of society. In an effort to show team solidarity and compassion for the "11" players (9 Hills, 2 Valley), an injured teacher, a divided township and in the spirit of true sportsmanship, honor and integrity we ask for all of you for forgiveness.

I think by and large that the people of Wayne want to see the team win. I know I do, despite my feelings about this matter. Despite my opinion about Coach Olsen in this matter, I believe he will motivate his players to rise above this and win this game.

the bottom line is that the vocal minority are offended that we have the nerve to question Olsen based upon his stellar past of being a great person in our community with all the good he has done. they think he should now get a free pass and people should look the other way. how dare we question his motives, his tactics, his decisions. SOUNDS VERY MUCH LIKE PENN STATE where the coach built up a very huge and loyal following. Then somehow the coach thought he could do no wrong and he could be untouchable since so many around him adored him and kissed his ring as they bowed before him. Olsen only feels that he is accountable to Olsen. And his minions around him, his loyal supporters who turn a blind eye to any misstep, will keep telling him that he is in the right. there is no way around this. the normal people will just have to deal with it i guess since there is no talking common sense into them

Excellent post. Some of the apologists here, will say that a fight between some kids is not the same as child abuse and I certainly would agree. However the point they would be missing , is the culture of; Acceptance of bad behavior; Looking the other way, and that a program (football or other) becomes larger and more important than the school, the town,the law. The apologists don't get that this time it's a fight we are talking about, what about next time? and the time after that. If there is no accountability for your actions, why follow the rules?

i never hear a valid explanation from the olsen faithful regarding olsen suspending players from other teams for misconduct in and out of school. he has suspended players for a game, multiple games, and even entire seasons. there was no due process, no hearings, no recourse. none of them were charged with a felony. it appears his players get preferential treatment as he is both the ad and the coach. does any of his supporters have a logical, valid clear-cut, concise explanation of why this does not look fishy? should he just get a pass on everything he does and never be questioned? dont you see the problems (penn state) of letting someone with authority run around unchecked and bullet-proof?

Obviously, you believe that the "game" is above all things? Interesting how twisted your thoughts and the thoughts of many "brainwashed" sports followers truly are. You see "withdrawing" would not be quitting at all. It would serve as the "ultimate" sacrifice. The quintessential gesture that basic human decency, honor and integrity prevails over any one sport. My Opinion, Part 1
This situation with regard to the Hills football players would be much less prevalent in these patch postings if;
1) The kids came forward and took full responsibility for their actions despite what potential consequences would come of this, if they are just justified.
2) Parents teaching their kids Moral Character, and some of them not placing a game before what is right vs wrong. NOTE - Exclusive of the upstanding players on the team not involved in any incident.
3) The coach having exercised some discipline before the Vernon game to those Truly involved. Coaches know! I like others have nothing personal against the coach and you can't take away the fact that he has won many titles. We must not forget that a game can never be placed above anybody, any administrative body, bad behavior both on and off the playing fields, arenas, etc.
4) The BOE did not flip flop over this situation and let it spiral out of control.
5) Parents hiring Attorneys to get their kids to play. The choice of who plays in a game or not is the responsibility of a coach in any sport, not an Attorney.
6) The Valley kids themselves need to take responsibility for their actions as well.
In my playing days my coach at the time benched me for a situation that I later had to go up to the official at the game and apologize. I took responsibility for my actions under the full guidance of my coach.

We are now at a point to let the judicial system go to work, which they are doing anyway, and render Judgement on who is guilty or not with the verdict.
Hopefully Wayne can come together in Unity like it has done in the past for which I have experienced and truly appreciated from a township. Let us all continue to focus on Major issues at hand for Wayne township such as;
* The chronic flooding problem
* High taxes
* Town leadership
* Etc.,

Mike disagree in part. The BOE failed miserably in this situation. In a crisis mode they get a F for Failure. They knew about this probably sometime around 10/30 or so. With Pavlak being a cop, the Board had to know. Why didn't they have their Board Attorney who I think is terrible come up with a stand on this one way or another. They should have researched this thoroughly and come up with a unified position from the getgo. First they said no, then they became neutral on the situatiion, then said no again. This is flip flopping. Indecisiveness at its finest. I haven't heard once about anything in regards to the HIB law. This board reeks to say the least! They all have to go starting with Ceberio, Pavlak, Kingston, Stinziale, Badiner, Esson, etal.

Wow--the venom directed at Coach Olsen and the Wayne Hills football program is amazing and so misplaced. You would think that Coach Olsen and the program arranged for the party, the fight, the family hired attorneys. I see no issue with debating what the right course of action is here--it is a free country. I think any of the kids found guilty of doing something wrong (Hills or Valley), should be accountable. However, this personal attack, after personal attack against a Coach and a program who has helped countless Student-Athletes, at both Hills and Valley, is so transparent. Seems like there have been some personal axes waiting to be ground and now is the time to strike. Coach Olsen could have simply kicked all of the accused off the team and distanced himself from the kids. However, some of the Hills kids are saying that they were not involved, were not there, wrongfully accused. So here is a Coach, standing by his kids until there is a detemination of innocence/guilt. We have judge, jury, and executioner all lined up based on some of the messages on this blog and maybe not in that order. At some point, all of the Olsen and Hills haters will get their wish and Coach Olsen will move on to something else in his life. Wayne will not be better off as a result.

The behavior is somewhat medieval, isn't it? The small group in this forum (Frank, Dory, Ira, George, and one or two others) have an issue with Coach Olsen and are using this incident to attack him. If you peel away the layers of baloney they're slinging, that is at the heart of it for them
The hypocritical part is they are hate mongers on a mission, claiming it's for the "good of the town", and "they know what's best", and "they understand leadership". If they all left it'd be good for the town. Who needs people with that have nothing better to do than stir up trouble.
The best part is, they all sit around all day patting each other on the back in this forum (assuming it's not the same person with 5 different names). They don't care one bit about what happens here to any of the people actually involved, just as long as they can sling crap, anonymously, at the coach.
What will they do when this is over? Oh, gang up on someone else thinking that their opinions are somehow having an influence.
In the meantime, my money is on Coach Olsen preparing the team to go out and win the game, as always. He'll play the hand he's dealt, and OT had better bring their A-game.

I have to agree with "nowhoyouthink" about one thing. There are people using this incident to smear Coach Olsen and those people do not care about anything else. There is something about anonymity on the internet that brings out the negative in some people. All I hear is punish, punish, punish without regard to guilt or innocence and all of that is followed by antipathy toward the football team and its coach. Punishment is meant to correct misbehavior not satisfy the blood lust of negative people. I doubt anything dished out at this point will decrease the likelihood that another fight will happen involving a WH Football player.
My children are not on the football team, if they were I would not appreciate what is being said about the team over and over and over by people who don't have anything to do with Wayne Hills Football. Those kids work very hard to accomplish what they have achieved. One incident involving a very few players should not be used to denigrate a whole group of dedicated athletes. GIVE THE KIDS A BREAK ALREADY, I had to stop following this thread because it clogs up my inbox.

At Rutgers I was part of half 3 on 3 intramural basketball tournament that resulted in a championship and resulting in being asked by the Rutgers head coachTom Young to be part of the practice team that worked out with featured two future NBA players Roy Hinson and John Battle. To date the Wayne Police Departments investigation found enough facts to arrest those young men. As a result they were "CHARGED" with Aggravated Assault. Those are all the "FACTS" The Wayne BOE, Supt. of Schools and the Principles of Wayne Hills & Valley need to suspend those young men from extracurricular activities. Those "ARRESTED" have not been expelled or suspended from school. The State DOE clearly gives the Township of Wayne all the tools they need to suspend those "Arrested".
There is one fact I'm curious about now, who is paying the attorney fees for those "ARRESTED" I wonder if Olsen is having a fundraiser for his boys. It could go something like... Listen you all have to give $150.00 (sound familiar) each to the fund, anyone not contributing is out (sound familiar) The Beefsteak dinner tickets are $150 each (sound familiar) but there will be no beef. There will be a 50/50, the cost per ticket (you guessed it) is $150.00. Finally we are auctioning off a day with Olsen, the starting bid is $150.00

wow....amazing stuff has been posted....I'm not in NJ anymore, but know this area pretty well and Chris Olsen. I don't know everything that has gone on. But, folks..let me tell you..this is a good man, a good coach as you know. He cares about his players like his own children. Always has..don't let this tear your community apart. From what I'm hearing, the BOE did what they had to do. Try to move on, and let the healing begin. Remember,high school sports are about the kids, adults who may have axes to grind maybe the real problems here. Best wishes.
