Parties to Meet for Settlement Conference on Wind Turbine
Robert Burke: 'I’m in this to be able to do what the town has illegally prevented me from doing.'
Wayne Auto Spa owner Robert Burke and the township are due back in court to try and settle a dispute involving a wind turbine that has dragged on for nearly three years.
Representatives from both sides are scheduled to meet at a settlement conference in federal court Sept. 12.
“I’m not in this litigation as a get-rich-quick scheme; I’m not in this for money,” Burke said. “I’m in this to be able to do what the town has illegally prevented me from doing.”
Burke applied in 2007 to install a 43-foot tall wind turbine with 6-foot long blades to generate electricity for his business, Wayne Auto Spa, on Hamburg Turnpike.
The Planning Board denied Burke’s application in October of 2008 citing a lack of expert testimony and concerns about safety and noise. State Superior Court Judge Donald Volkert overturned the denial in July 2010 but the town has refused to issue the building permits. Burke is suing the township for the issuance of the permits.
“There is no circumstance in which I will settle this case without those permits,” Burke said.
Residents strongly objected to Burke’s application, claiming the turbine would be dangerous and noisy, concerns the board shared. The property is located near single-family homes and a daycare facility.
In his decision, Volkert said that the board improperly denied the application due to the concerns.
“The board should have granted minor site plan approval and used its authority to place reasonable conditions to mitigate any noise or safety impacts,” Volkert said in his ruling. “The board did not have the authority to enforce noise or safety ordinances. That is the responsibility of administrative departments.”
Burke is also looking to recoup between $250,000 and $300,000 in legal fees he claims he is owed. If the township is forced to pay Burke the money will be taken out of the municipality's Joint Insurance Fund, not the municipal budget funded by local taxes.
“I’m confident that I’ll get back every penny of what I am owed,” Burke said.
The council approved an ordinance in December 2009 permitting wind turbines to be installed in industrial areas in the township but not at the Wayne Auto Spa.
Burke said he has reached out to township officials with a settlement offer multiple times but has not heard anything back. Assemblyman Scott Rumana, who was mayor at the time of Burke’s initial application, declined comment, except to say that he “always had reservations about the project due to its proximity to single-family homes and a daycare center.”
Mayor Chris Vergano declined to comment because the matter is still pending in court. Township attorney Matthew Giacobbe also declined to comment. Assistant Township Attorney John McKniff could not be reached for comment.
“We can stop the bleeding. The town can pay the legal fees that are incurred to date and issue the permits that I’ve already won and we can put it to bed,” Burke said. “Or, we can continue to litigate and it’s only going to cost a lot more money.”

Good Luck Burke. Wayne does not know the first thing about sustainability. All they know how to do is write checks and it looks like they are going to be writing another one
When the town has to pay his legal fees, it should come out the board members pockets. It was there mistake. Their egos blinded them from doing their do diligence.
Taxpayers should not have to pay this. They illegally denied the permits and this should not have gone on this far. Why did the town attorney allow this to happen?
Wayne residents should be livid over this waste of taxpayer money. Over what looks like school yard bullying. Board members were hoping Mr. Burke could not afford the fight, and hoped he went away.
This matter needs to be looked into. Looks like they were trying to protect Scott Rumana. The only problem is they were using Wayne resident’s money to do so.

Thanks for your comment, Cosmo. The Town's not really fighting about a wind turbine; they approved one for Rumana on Wayne Valley High Scool. They're punishing me for challenging Rumana politically (and the Council & PB) in a very public way. Hubbard neglected to mention that the Town is already footing a roughly $50,000 bill from my lawyers for the Town's refusal to permit me access to a public record. Can you imagine? They wasted $50,000 taxpayer dollars because they refused to just provide the document (a lawyer's bill). Very arrogant.

Wow, I think you are right. This burdon should not be put on Wayne taxpayers. This issue has been going on for a long time and from what I understand Wayne has lost every court battle with the carwash. $250,000 is a lot of money and could be used for much more important things. To have to pay that over board members not doing their job is an outrage. It will be interesting to see what happens.

Thanks for your comment, Michelle. You are correct -- the Town has lost every time a Judge has made a decision in this multi-year battle. That's about 6 decisions so far -- including a determination by a unanimous three judge panel from the Appellate Division that dubbed the Town's actions as "frivolous." Yet in reply to my settlement offer at a Council meeting a few weeks ago, the Mayor actually ridiculed me. I'm not especially optimistic that this court mandated settlement conference will be productive. Its a shame -- the Town could have taken the opposite approach and collaborated and cooperated with me to achieve a mutually acceptable solution and taken credit for being a municipality leading the way in sustainability.

"However, the Planning Board's concerns about nooise and safety appear to conflict with the Township's approval of a wind energy system to be placed at a high school. Defendant Paul Margiotta, a Planning Board member at the time of applicant's decision was a member of the Town Council that approved the wind turbine at the high school and the Township's Mayor [Vergano] attends meetings of both the Town Council and the Planning Board. Thus, the Planning Board could not plead ignorance on health and safety issues."

It's amazing to see that those in power are carrying out personal agendas at the expense of the taxpayers. From this article, it seems the planning board didn't even have the authority to deny Mr. Burke the permits, yet they did anyway. The system is supposed to be in place in order to reasonably and rationally protect the interests of all citizens. Perhaps rather than fearing that which they did not know much about (I.e., the windmill), they could have had windfarmers from around the state come to discuss this sustainable technology. This sounds to be a classic example of fear of the unknown. Had the board been more open-minded and less impulsive, it would have saved us all a lot of time, money, aggrevation, and unnecessary CO2 emissions!! Keep at it Rob; future generations are thanking you for it.

Thanks for your comment, Alex. In fact, I brought to the Planning Board a gentleman from South Jersey named Carl Baldino. Mr. Baldino lives in a suburban neighborhood much like those in Wayne. He has the same wind turbine that I applied for. In his backyard, 40 feet from his house.
Get this: When he testified that he could not even hear the turbine from his backyard deck, Chairwoman SuBonnie forbade him from speaking because he is not a sound expert!! He was a fact witness, not an expert and was only testifying to his experience with the identical wind turbine. What a joke!
And PB Member Tim Collins asserted that the climate in South Jersey is so different from the climate in North Jersey that Mr. Baldino's experience with the identical machine is irrelevant!!! OMG!!! Do I really need to comment on that????
And these are the very same folks who approved Scott Rumana's wind turbine to be placed on Wayne Valley High School -- for educational purposes.

Thanks for your comment, Wayne Voter. Not sure if anyone can successfully challenge the Rumana Machine in an election. Of course, his pending ethics charges won't help him much, but that's another story. In the meantime, I plan on making all the data from my turbine available in real time on my web site, with explanations. While the results are always site specific, they will help folks like you learn what these machines can do.

I've said this before on nj.com and I'll say it again here. The township needs to cut it's losses and act responsibly in how they use OUR tax dollars. They lost. Burke won. The process was abundantly fair (as would be expected with Judge Volkert). Game over. Elected officials - give it up already. We pay enough taxes already - all you're doing now is chasing windmills (sorry for the man of la mancha reference, but it fits). Give the man what is rightly his - the windmill, his legal fees, and (this is a real long shot) an apology.

Stewart -- Thanks for your comment. Having been ridiculed by Mayor Vergano in reply to my offer to end the hostilities at a recent Council meeting, I have to agree with you. An apology is highly unlikely. Unfortunately, so is a negotiated settlement. Township officials continue to disregard their legal obligations and don't seem to care much about right & wrong. I hope I'm mistaken, but I rather doubt it. At this point, there is no question that this fight has changed my life and my family's -- I must see it through to the end. I have no other option.

Here's something else you should know.
Wayne's Court Adminstrator & Police violated my rights when I was attacked in October 2007 - over the wind turbine. My right to file a complaint was denied because I didn't have my attacker's home address. I had his name, business address & make, model & color of his car. The man is in private law enforcement/security for a company HQ'd in Wayne & a former Sheriff's Officer.
The AG directed the County Prosecutor to investigate.
The results of the "investigation" were told to me at a meeting with Prosecutor Dilella. I gave a recording of the meeting to the Council.
DiLella said the Wayne police refused to investigate my complaint.; they didn't interview my attacker or any witnesses. He confirmed that Wayne's Court Administrator denied my right to file a complaint for the same reason.
The Passaic County Court Administrator wrote a letter confirming this and they've directed Wayne not to do this ever again!
Here's the most interesting part.
Town Atty Semeraro wrote me a letter saying the police fully investigated my allegations and they could not be substantiated.
Either Dilella's statement is true or Semeraro's is true -- but they both cannot be true.

The US Attorney's office doesn't seem to care. Nor does Christie's Attorney General. I've been persistent and continue to be. The only way these facts will come out and see the light of day is if this case goes to a jury. Otherwise, the folks in control of the government are doing an excellent job at protecting the wrongdoers.
I used to believe in American democracy, the Constitution and so on. I actually still do. But like Tip O'neill used to say. All politics is local. And the folks in control of the local government here in Wayne are lawbreakers, plain and simple. Holding them accountable is difficult -- and perhaps even impossible.
Time will tell.

What a desperately sad picture this stupidity of the Wayne elected officials paints for any new business reviewing the potential to locate in our town ! Even with the Blue Laws closing stores on Sunday , Paramus is way beyond us in hospitality and compatibility to business. At first I was all for Rob Burke putting the turbine in, but then the more I checked into turbine construction it's apparent that they are made to be constructed in places where residents (or day care centers) are not within breakdown reach (a scary thought). These structures are not as reliable as manufacturers have claimed (check out the article in Business week). "Gearboxes hiding inside the casings perched on top of the towering masts have short shelf lives, often crapping out before even five years is up. In some cases, fractures form along the rotors, or even in the foundation, after only limited operation. Short circuits or overheated propellers have been known to cause fires. All this despite manufacturers' promises that the turbines would last at least 20 years." (as quoted in Newsweek).
I applaud Mr Burke for his "green" car wash, but I think that now he has turned this fight into a vendetta toward the town, which is now costing the taxpayers of Wayne money. His "green" philosophy did a total turn around when he agreed to allow T-Mobile to put up a cell phone tower. Giving no thought to his employee's health, the neighbors, or the environment. Obviously he didn't do his "green" research on how bad cell towers are, especially for young kids (remember there's a day care next door). For those of you that don't know how bad cell towers are, just check out "Full Signal" a scary movie on cell tower effects on people. I no longer use his car wash, I go elsewhere.

In the interest of full disclosure, Sydney, your position about me and my plans to develop my property changed when I signed a lease with T Mobile for a cell tower. You now oppose me not because of a wind turbine, but because T Mobile also plans to install a cell tower near your house. So you are now a vocal, outspoken challenger of T Mobile, which is all well & good.
But stop the lies & the feat mongering about wind energy. Pres. George HW Bush installed the same system at his house in Maine. The Secret Service are fine with it and they are responsible for protecting the ex Prez. Here's the article:

Properly placed a wind turbine is a wonderful thing, but in a crowded residential zone with a day care center located within a few feet it becomes a liability. Oh come on, George Bush's property is a huge ranch and certainly has enough space for a wind turbine that wont fall on anything but your small property certainly doesn't have the space. I know you didn't do the research on the cell tower, so I certainly wouldn't expect you to research wind turbine space dangers either (they do have much smaller turbines that wouldn't be as dangerous as the one you are proposing). So Business Week is feat mongering maybe you should go after them too. I just don't like the fact that you go off on how "green" you are and yet you signed on for a cell tower... just shows that the "green" you are talking about is not the environment but what you can put in your pocket. Greed before thinking about your employee's health. Shame on you.

Sydney: Your facts are wrong as are your conclusions. First,. the Bush Wind Turbine is adjacent to a single family home in Maine. Literally, adjacent. Click on the link I provided and see for yourself. The car wash is NOT in a residential zone; the wind turbine will be completely, 100% in a business zone. Second, how do you "know that I didn't do the research" on cell towers or on wind turbines? You happen to be wrong. Third, my property is more than two acres and the "fall zone" of my wind turbine is entirely on my property (whereas the "fall zone" of my flagpole and my signs would cross my property line into the road or neighboring properties. Fourth, the idea that I could put a 100 foot cell tower on my property but can't put a 43 foot wind turbine there is absurd -- and getting one or both will help make that point to everyone. The notion that I am somehow a bad person because they would both threaten the health and welfare of people is wrong; and I would be victimizing myself purposefully too since I work at Wayne Auto Spa. The fact that T Mobile will pay me rent? Well, the only reason I need the rent is to pay lawyers to deal with Wayne's illegal behavior. Unless a pile of money falls out of the sky, I will do what Wayne Twp did on Nellis Drive, next to an apartment building and the municipal complex: collect rent from a cell tower. And I make no apologies.

Rob, I’ve been following your story from the beginning and it’s pathetic with what these officials are putting you through. I feel for you. I work for an engineering firm and I see how difficult the municipalities can be when it comes to solar or wind power. My friend just came back from Germany and said there are solar planes or wind turbines everywhere. We are so far behind when it comes to Green Energy. What a shame. Bob good luck. Thanks, Debbie. It should be clear to all by now that this fight has little to do with renewable wind energy. This is about stifling political discourse. This is about retaliation for challenging the supreme political rulers of the local domain, who funnel our tax moneys to the bank accounts of their friends. This is about right & wrong, democracy and the Constitution. I'm reminded of the scene from Animal House, where the fraternity is up on charges and the Dean won't let them present their case. Town machers wrap this thing up. Issue the permits and get out of the way. The idea that land use permitting should interfere with local business to such an extent explains some of why our economy is in the tank. The Chinese can build a transcontinental high speed rail line in a year, we take two years to get through the local planning department. Get this thing done and settled.

I have already called the councilman in my ward. I want answers. We can post things on here all daylong. But nothing is going to change unless we demand it does.
Regardless of how you feel about the issue. This man was attacked at his workplace.
He got the attackers name, business address & make, model & color of his car.

Bob,
Im a resident in town and have been for almost 50 years. I grew up here, and I'm raising a family here. Im all for the wind turbine. I think the idea is innovative. I would feel the same way if it was used for a car wash, a hot dog/burger joint, or a used car lot.
I also feel the taxpayers should pay your costs- town hall thinks they can do anything they want to, and it takes people like yourself to make a point that they are not above the laws that are created. We employ or elect our officals to enforce the laws the way they are written, and don't hold them responsibile for "what's not" in the law. If we did, they all would have been fired long ago.

your right on that Rob, but that's not how it works. If it were, Scott would be standing outside K-Mart with a tin cup. The plain and simple fact is -instead of continuing to agrue the case after you won, the residents should have had the common sense to end it without paying an added 250k "insult on top of injury" fee. They could have stopped the non-sense. The difference is- it this was 1962, 1972 or 1982 - it would have been over. Our current board is comprised of idiots with ego's, and not a lick of common sense. Take a good look around town- I rest my case.

Land use laws should not be twisted and turned with the political wind. That is what towns want to do to keep people happy. But the fact remains that people are permitted to use their land to their profit and betterment if there is no offense to the law. This case does not offend the law just because some nimby folk go before the town and complain. The town fathers need to grow a set and simply tell the nimby crowd that thise is a permitted use--get over it.

You are absolutely right, Scondo. but remember, if this were just about land use & NIMBYs this would have been resolved a long time ago. No one believes that the Town is genuinely concerned about land use issues -- neither will the jury. Its plainly clear to all who become informed of the facts I've posted in these comments that the Town is purposefully retaliating against me because of my political activities and my Constitutionally protected speech criticizing the local pols. Why else would the police turn their backs on me? Why else would the court refuse to permit my complaint? I forgot to mention that Mr. Hubbard is mistaken on who will pay for the damages in this case. He said that the Town's insurance carrier will pay for it. That's not really the truth. First, the insurance carrier is a governmental self insurance fund. Its a collection of towns, basically, making an insurance pool. If the fund pays, they will recoup what they pay through higher premiums to Wayne.
More to the point is this. The Town refused to give me the reservation of rights letters from the Fund on this case. Only after I persisted and threatened suit, did the Town provide those letters, yesterday.
In them, the Fund says that it will NOT PAY for liability for INTENTIONAL ACTS. My entire civil rights count is for intentional acts. The Town DOES NOT HAVE COVERAGE from its own self insurance fund for intentional acts.
Accordingly, the best outcome for the taxpayers & the municipal defendants is to negotiate a settlement and have the fund pay for it, even if the Town's premiums do go up later. And they better do it fast, because the coverage amount is reduced dollar for dollar by the fund's legal fees. My demand amount should still be within the coverage limit -- but not for much longer as the fund's politically connected lawyers suck the public teat and drain fund money for frivolous litigation practices.

That is the problem, Wayne residents have NOTHING to gain from this fight. The broad members are not working in our best interest. Wayne can not sue Burke, he has done nothing wrong.
This is there battle, but they are using our (town) money.

I agree, build the damn thing. Don't worry about who has to pay the fine Bob, if the court rules in your favor there shouldn't be any ill-feeling. They wouldn't hesitate to fine you if there was foul-play.
The only part of the whole arguement that I can't understand is why the Wayne police didn't investigate the complaint further. We have a very competent force that doesn't have a reputation for letting complaints fall trough the cracks like your's did, even when they are protecting they're own, which happens from time to time. It wouldn't suprise me to hear they turned things around to make it sound like you assaulted the PCSO , but to ignore it completely leads to speculation.

forget the police. what about the court? do you really think the wayne court administrator EVER denied anyone but me the right to file a complaint b/c i only had a name, business address, make,. model, color & license plate of car but no home address?
my complaint fell through no cracks. it was ceremoniously flushed down the toilet of wayne township corruption. and then processed by rumana planning board soldier tim collins at the sewer plant.
you wonder why this country's economy is spiraling into oblivion?

He presented it to Scott who didn't even have the courtesy to say thank you. Meanwhile, he is consistently the only pol to use the Wayne fireworks to troll for votes.

Sophisticated pols are smart. They always say 'yes' when it doesn't cost them anything -- when the moment that the pol actually has to deliver arrives, only then do they make the genuine decision. Always saying yes when it doesn't cost anything is a standard political practice.
Scott isn't dumb -- saying thank you and feigning interest would have cost him nothing. Besides, it was important enough for your father to bring him the photo -- should've tipped Scott off to be more sensitive.
Take the wind turbine too -- classic Rumana arrogance. He could have avoided the entire controversy AND killed the wind turbine in an elegant, non controversial way.
He could have said, 'Interesting idea, don't know much about it. i'm forming a green ribbon panel to study it and make recommendations. Burke, you chair the committee. Here are the other 40 folks I'm appointing. Good luck herding cats, talk more on this next century.'
That would have really put me in a box. But instead, he stomped on my head with steel toe boots and spit all over the constitution in the process.

Andy Kruse, from Southwest Wind, the manufacturer of the Skystream Wind Turbine mentioned to me after reading this article that he enjoyed the one comment from Rumana: I always had reservations about the project due to its proximity to single-family homes and a daycare center.
Kruse wondered why Rumana didn't bother to find out that there are 8000 Skystreams installed near single family homes and schools.
This has more to do with Rumana's ego & political retaliation and less to do with reality.
